DISTANCE SALES AGREEMENT

1. PARTIES

This Agreement has been signed between the parties below under the provisions and conditions specified below.

By accepting this agreement, the BUYER undertakes to pay the order amount, as well as any additional charges such as shipping fees and taxes, upon confirmation of the order, and acknowledges that they have been informed about this.

2. DEFINITIONS

In the implementation and interpretation of this agreement, the following terms shall mean the explanations written next to them.

SERVICE: The subject matter of any consumer transaction made in return for a fee or benefit, other than providing goods,

SELLER: The company that offers goods to the consumer within the scope of commercial or professional activities or acts on behalf of or for the account of the party offering the goods,

BUYER: The natural or legal person who acquires, uses, or benefits from a good or service for non-commercial or professional purposes,

SITE: The website owned by the SELLER,

ORDER PLACER: The natural or legal person who requests a good or service through the SELLER's website,

PARTIES: The SELLER and the BUYER,

CONTRACT: This agreement concluded between the SELLER and the BUYER,

GOOD: The movable property subject to purchase and non-material goods such as software, sound, image, and similar items prepared for use in electronic media.

3. SUBJECT

This Agreement regulates the rights and obligations of the parties in accordance with the provisions of Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts regarding the sale and delivery of the product with the characteristics and sales price specified below, which the BUYER has ordered electronically through the website of the SELLER.

The prices listed and announced on the website are the sales prices. The announced prices and promises remain valid until updated and changed. Prices announced for a limited time are valid until the specified period.

7. PRODUCT/S INFORMATION

1. The basic features of the Goods/Product/Products/Service (type, quantity, brand/model, color, quantity) are published on the SELLER's website. If a campaign is organized by the seller, you can review the basic features of the relevant product during the campaign period. It is valid until the campaign date.

7.2. The prices listed and announced on the website are the sales prices. The announced prices and promises remain valid until updated and changed. Prices announced for a limited time are valid until the specified period.

7.4. The shipping cost, which is the shipment expense, will be paid by the BUYER.

9. GENERAL PROVISIONS

9.1. The BUYER acknowledges, declares, and undertakes that they have read and understood the basic characteristics of the product subject to the contract, the sales price, payment method, and delivery information on the SELLER's website, and confirmed the Preliminary Information electronically before the conclusion of the distance sales contract. The BUYER acknowledges, declares, and undertakes that they have obtained the correct and complete information about the delivery address, the basic characteristics of the ordered products, the prices of the products including taxes, payment, and delivery information.

9.2. Each product subject to the contract will be delivered to the BUYER or the person/entity at the address indicated by the BUYER within the period specified on the website, depending on the distance of the BUYER's place of residence, provided that it does not exceed the legal period of 30 days. If the product cannot be delivered to the BUYER within this period, the BUYER has the right to terminate the contract.

9.3. The SELLER undertakes to deliver the subject of the contract in full, in accordance with the specified qualifications in the order, and, if any, the warranty documents, usage manuals, the necessary information and documents required by the nature of the business, in accordance with the legal requirements, in a sound, standard manner, and with due care and diligence, to maintain and improve the quality of service, to act with caution and foresight during the performance of the work, and to fulfill its obligations in accordance with the legal regulations, apart from any defect.

9.4. The SELLER may provide a different product of equal quality and price by informing the BUYER and obtaining their explicit consent before the expiration of the performance obligation arising from the contract.

9.5. If the SELLER is unable to fulfill the contractual obligations due to reasons such as force majeure that arise beyond the control of the parties and prevent or delay the fulfillment of the parties' obligations, the SELLER undertakes to inform the BUYER in writing within 3 days from the date of learning about this situation, and to refund the total amount to the BUYER within 14 days. 

9.6. The BUYER acknowledges, declares, and undertakes that in case the price of the product subject to the contract is not paid for any reason or canceled in the bank records, the SELLER's obligation to deliver the product subject to the contract will cease.

9.7. After the delivery of the product subject to the contract to the BUYER or the person/entity at the address indicated by the BUYER, in case the credit card belonging to the BUYER is used by unauthorized persons, resulting in unauthorized use, and the product subject to the contract price is not paid to the SELLER by the relevant bank or financial institution, the BUYER undertakes to return the product subject to the contract to the SELLER within 3 days at the expense of the SELLER.

9.8. In case the SELLER cannot deliver the product subject to the contract within the performance period of the parties due to force majeure events such as unforeseen events that prevent or delay the fulfillment of the parties' obligations, the SELLER undertakes to inform the BUYER about the situation and the BUYER has the right to request the cancellation of the order, the replacement of the product subject to the contract with its equivalent, if any, or the postponement of the delivery period until the obstructive situation is eliminated.
